If you accept or agree to the Agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to the Agreement. In such event, "you" and "your" will refer to that company or legal entity.

Boost reserves the right, at its sole discretion, to modify, discontinue, or terminate the Sites, or to modify the Agreement, at any time and without prior notice. If the Agreement is modified, the modification will be posted on the Sites. Continued access or use of the Sites after such modification indicates acceptance of the modified Agreement.

In addition to the Sites, Boost provides Customers and Authorized Users access to its products (the "Boost Product(s)"), subject to the terms and conditions of the Master License, Subscription and Services Agreement between each Customer and Boost ("Master Agreement").

Boost is available only for adults aged 18 years or older.

You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Boost reserves the right, in its sole and absolute discretion, to deny access to the Sites or any portion thereof, without notice and without reason.

The Sites are protected by copyright, trademark, and other laws of the United States and foreign countries. Except as expressly provided in these Terms of Service, Boost and its licensors exclusively own all right, title, and interest in and to the Sites, including all associated intellectual property rights.

You may view all content on the Sites (the "Content") for your own internal business use and not for any other use, including any commercial use, without the prior written consent of Boost. All right, title, and interest, including all intellectual property rights, in and to the Content are retained by Boost and its licensors.

The trademarks, service marks, and logos of Boost used and displayed on the Sites are registered and unregistered trademarks or service marks of Boost. Nothing on the Sites should be construed as granting any license or right to use the Trademarks without prior written permission.

Elements of the Sites are protected by trade dress, trademark, unfair competition, and other state and federal laws and may not be copied or imitated in whole or in part. None of the Content may be retransmitted without express, written consent for each and every instance.

You agree not to use the Sites in any manner that could damage, disable, overburden, or impair the Sites, or interfere with any other party's use or enjoyment of the Sites. You agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Sites.

You agree not to use the Sites for any unlawful purpose or in violation of any applicable law, regulation, or ordinance. You agree not to upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

In no event shall Boost, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Sites.

Boost's total liability for any claims arising under these Terms of Service shall not exceed the amount paid by you, if any, to Boost during the twelve months prior to the date the claim arose.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Austin, Texas.
